From the dawn of time, when early man first ventured into northern climes, there have been snowball fights. Most have been good-natured, some less so. But rarely has there been litigation.
You of course recall the Great Snowball Incident of 2008 (video following the jump), when the Jets’ Shaun Ellis nailed a Seahawks fan with a ginormous snowball following Seattle’s win at the Meadowlands. Now the fan, Robert Larsen, is suing. TMZ:
In the suit, Larsen — a Seahawks season ticket holder — claims he had been waving a pro-Seahawks sign … which made him a perfect snowball target.
Larsen claims Ellis said the snowball toss was “all in fun” — but Larsen says he was seriously messed up in the incident … and has suffered physical injury, humiliation, mental distress, pain and wage loss.
Tell me if I’m interpreting this wrong, but appears in the video as if Larsen caught the snowball and is celebrating with it, like he’s just been given a souvenir. (You don’t want Ellis signing this one, though. Think about it).
If the video is exhibit A, this suit will not go well for Larsen. I’d also like to see him prove mental anguish and loss of wages. Unless he’s a Victorian-era undertaker whose enormous top hat is knocked off his head by copycat snowball attacks every time he leaves the house, I don’t think he has much of a case.
